Service Terms & Conditions
These Terms & Conditions apply to all estimates, proposals, invoices, and services performed by Hadley’s LLC, doing business as Hadley’s Tree & Lawn. Acceptance of an estimate, scheduling of service, or payment of an invoice constitutes agreement to the following terms.
Estimates
All estimates are based on a visual inspection of the property and conditions visible at the time of quoting.
Hidden conditions including but not limited to decay, embedded metal, fencing, underground utilities, structural instability, or limited equipment access may require adjustments to the final price.
If unforeseen conditions are discovered, the customer will be notified and approval will be obtained before additional work proceeds whenever possible.
Estimates are valid for 30 days unless otherwise stated.
Property Access
The customer agrees to provide clear and safe access to the work area prior to the scheduled service date. This includes moving vehicles, trailers, outdoor furniture, toys, and other personal property.
Hadley’s Tree & Lawn is not responsible for damage to items left within the work area.
Underground Utilities & Irrigation
The customer is responsible for identifying and marking any underground systems including but not limited to:
Irrigation and sprinkler systems
Septic tanks or lateral fields
Invisible dog fences
Landscape lighting wiring
Private utilities or cables
Hadley’s Tree & Lawn is not responsible for damage to underground systems that are not clearly marked or disclosed prior to work.
Lawn and Landscape Impact
Tree removal, stump grinding, and equipment use may cause minor lawn disturbance including tire marks, soil compression, or surface damage.
While reasonable care is taken to minimize impact, lawn repair or restoration is not included unless specifically stated in the estimate.
Debris Removal
Unless otherwise specified in writing:
• Brush and debris will be removed from the property.
• Firewood may be cut and left on site if requested.
• Stump grinding debris (wood chips and soil mix) is typically left on site unless removal is requested.
Weather and Scheduling
Tree work and outdoor services are dependent on weather and safe working conditions.
Hadley’s Tree & Lawn LLC reserves the right to delay, reschedule, or stop work due to:
Severe weather
High winds
Lightning or unsafe conditions
Equipment failure
Emergency storm response priorities
Payment Terms
Payment is due upon completion of work unless otherwise agreed in writing.
Accepted payment methods may include:
• Cash
• Check
• Online invoice payment
Large projects may require a deposit prior to scheduling.
Late Payment Fees
Invoices not paid within 15 days of the invoice date may incur a late fee of 5% of the outstanding balance.
Balances unpaid after 30 days may accrue additional collection costs, administrative fees, or interest as permitted by law.
The customer agrees to be responsible for reasonable costs of collection, including attorney fees or court costs if required to recover unpaid balances.
Right to Stop Work
Hadley’s Tree & Lawn reserves the right to pause or stop work immediately if:
Payment terms are not honored
Unsafe working conditions arise
Equipment access becomes restricted
Customer interference prevents safe operations
Any work completed up to that point will be invoiced and due according to the payment terms.
Storm Damage & Emergency Work
Storm-damaged trees can be unstable and unpredictable.
Hadley’s Tree & Lawn will take all reasonable safety precautions but cannot guarantee control of compromised trees, limbs, or debris during removal due to hidden structural damage.
If trees or limbs are in contact with utility lines, the utility provider must address the situation before work can begin.
Insurance
Hadley’s Tree & Lawn maintains appropriate liability coverage for tree service operations. Proof of insurance may be provided upon request.
Mechanic’s Lien Rights
Failure to pay for services rendered may result in Hadley’s Tree & Lawn filing a mechanic’s lien against the property as permitted by Missouri law.
Limitation of Liability
Tree service operations involve inherent risks due to natural conditions and structural instability.
Hadley’s Tree & Lawn is not responsible for damage resulting from:
Hidden tree defects or internal decay
Natural falling patterns of compromised trees or limbs
Pre-existing structural weaknesses in trees
Acts of nature or severe weather conditions
Governing Law
These Terms & Conditions shall be governed by the laws of the State of Missouri, with jurisdiction in Lincoln County, Missouri.
Acceptance of Terms
Acceptance of an estimate, scheduling of work, or payment of an invoice constitutes agreement to these Terms & Conditions.
